1. Program and relationship to other terms
The Founding Hotel Program (the “Program”) is a program run by The Artifics, Inc., a Delaware corporation (“The Artifics”, “we” or “us”), through which selected hotel operators evaluate Guester in their real operations and help shape the product. These Program Terms supplement the Evaluation Access Terms and the Master Subscription Agreement (Terms of Service). The Data Processing Agreement applies to personal data. If these Program Terms conflict with the Evaluation Access Terms on approval, duration or extension of access, the Evaluation Access Terms prevail.
The Program does not create a partnership, joint venture, investment, agency, franchise or exclusivity relationship. Participating hotels remain independent and acquire no equity, profit-sharing or ownership interest in The Artifics or in any development.
2. Applications and selection
Hotels may apply through the Program page while applications are open. Submitting an application does not create a right to participate or to receive access. The Artifics selects participants at its sole discretion, taking into account factors such as property type, operational fit, integration readiness and the value of the hotel’s participation for product development. We may decline applications without giving reasons and may close or change the Program at any time.
3. Evaluation Access for participants
Selected participants receive Evaluation Access only through a written Evaluation Grant identifying the properties, modules and Evaluation Period. Each Evaluation Period lasts no more than three (3) calendar months. Any extension requires The Artifics’ prior written approval, may last no more than three (3) calendar months each time and is granted at our sole discretion, as set out in the Evaluation Access Terms. Being selected for the Program does not guarantee any particular duration, extension or module.
Program participation is free of charge during an approved Evaluation Period and never converts automatically into a paid subscription. Any paid continuation requires a separate Order that the participant expressly accepts.
4. Feedback
Participants are invited to share feedback on their workflows, report issues through support and, where they agree, take part in short feedback sessions. Feedback is voluntary, unless an extension of Evaluation Access is expressly conditioned on participation in feedback sessions. Participation is never conditioned on positive public reviews, references or a stated level of satisfaction, and honest criticism is welcome. Feedback is handled under the feedback provisions of the Agreement; we do not publish a participant’s confidential information or personal data.
5. Founding status and publicity
We may refer to participants as “founding hotels” internally. The use of a participant’s name, logo, screenshots, quotations or case study in public, including on our websites, requires the participant’s separate prior written permission, which may be withdrawn for future use. General acceptance of these Program Terms is not such permission. We do not present Program results as guaranteed revenue increases or unverified success claims.
6. Data and operational boundaries
Real PMS, reservation and personnel data may be used only within the DPA, the disclosed subprocessors and the processing purposes and transfer arrangements required by law. Program acceptance does not replace guest or employee notices or required transfer instruments, and does not enable external actions; those require separate authority under the AI, Automation and Integration Authority.
7. Ending participation and changes
A participant may leave the Program at any time without penalty through its account or by writing to info@theartifics.com. The Artifics may end a participant’s Program participation or Evaluation Access as described in the Evaluation Access Terms. At the end of participation, data export and deletion follow the Evaluation Access Terms and the DPA.
The Artifics may update these Program Terms; changes do not shorten an Evaluation Period already granted, except as permitted by the Evaluation Access Terms. Version 4.1. The document date shown at the top of this page is the date this version was published.
