1. Websites and operator
These terms govern access to and use of theartifics.com and guester.co (the “Websites”), their content and the contact, demonstration and application forms on them. The Websites are operated by The Artifics, Inc., a Delaware corporation (Delaware File No. 10805181) with its principal office at 2810 N. Church Street, STE 91313, Wilmington, Delaware 19802, United States (“The Artifics”, “we” or “us”). The Artifics is the company; Guester is its hotel software product. Contact: info@theartifics.com. The Guester service is provided under the separate Master Subscription Agreement (Terms of Service) and related documents. These Website terms do not create a subscription, accommodation sale or authority to act for a hotel. Viewing a Website, requesting a demonstration or applying to a program does not create a subscription or grant Evaluation Access.
2. Nature of content
The Websites may contain product descriptions, example screens, articles, events and contact information. Demonstration and sample data are not actual hotel results. A feature’s appearance on a Website does not mean it is available to every user or included in an agreement; service scope is determined in the applicable Order before acceptance.
Development plans may change. Website content is general information and is not legal, tax, financial or other professional advice for your own obligations. Statements about revenue, compatibility, compliance, availability or certification apply only where expressly stated within a verified scope.
3. Permitted use
You may access the Websites, read their content for your personal or internal business evaluation and send enquiries with accurate information. No content rights are transferred to you. Using Website names, logos or images beyond statutory exceptions requires the permission of the right holder.
You must not send malware or misleading enquiries, compromise or test the security of the Websites, use another person’s information without permission, overload the servers, scrape content in bulk or collect personal data unlawfully. Security issues can be reported to info@theartifics.com without unnecessary personal data.
4. Intellectual property and links
The Websites, their content, designs and software, and the names and logos of The Artifics and Guester, are owned by The Artifics or its licensors and are protected by intellectual property laws. Open-source and third-party elements remain subject to their own licences. Republishing content without permission, implying an association with The Artifics or Guester or using their marks in a misleading way is prohibited.
Links to third-party websites are provided for convenience. We do not endorse or assume responsibility for third-party content, which is governed by its own terms. We take reasonable steps to correct material errors in our own links and descriptions.
5. Demonstrations, contact and marketing
Demonstration, contact and program enquiries are used to assess and answer the request. Please submit accurate information limited to what is needed and do not send guest lists, passwords, payment card data or other sensitive records through a Website form. A secure channel is provided separately if specific data must be shared.
Answering a request does not subscribe you to marketing communications. Where required by law, marketing choices are offered separately and are optional. Evaluation Access, the use of logos and account activation each follow their own express acceptance process.
6. Privacy and cookies
Our processing of visitor and enquiry data, the legal bases, recipients and your rights are explained in the Privacy Notice. Website technologies and the related choices are explained in the Cookie Notice. Visiting the Websites is not consent to optional cookies or to international transfers.
7. Availability and liability
We take reasonable care to keep the Websites secure and accurate, but we do not guarantee that they will be available without interruption or free of errors. Maintenance, technical issues and third-party outages may affect access. Before making important decisions, please check the offered scope and current conditions with us.
The Websites are provided free of charge and “as is”. To the maximum extent permitted by law, The Artifics is not liable for indirect or consequential losses arising from use of the Websites, and its total liability arising from use of the Websites is limited to USD 100. These limits do not apply to liability for intentional misconduct or gross negligence or to any liability that cannot be limited by law, and they do not affect the rights of Guester customers under their service agreements.
8. Changes and governing law
We may update these terms by publishing a new version on the Websites; the date and version are shown on this page. Updates do not apply retroactively to agreements already accepted for the Guester service.
If you use the Websites from Türkiye, Turkish law applies, without regard to its conflict-of-laws rules, and the Istanbul Central (Çağlayan) Courts and Enforcement Offices have non-exclusive jurisdiction. Otherwise, the laws of the State of Delaware apply, without regard to conflict-of-laws rules, and the state and federal courts located in New Castle County, Delaware have non-exclusive jurisdiction. Mandatory consumer protection rights and the right to apply to data protection authorities are not affected.
