Cancelling monthly and annual subscriptions, and the limited cases in which unused fees are refunded.

This Guester product document is also published on guester.co. The reference copy is available at guester.co/legal/refund-policy/.

This Refund and Cancellation Policy applies to paid Guester subscriptions provided by The Artifics, Inc., a Delaware corporation (“The Artifics”, “we” or “us”), and forms part of the Master Subscription Agreement (Terms of Service) (the “Agreement”). Capitalized terms have the meanings given in the Agreement. If an Order Form signed by both parties contains different refund terms, the Order Form prevails.

Evaluation Access under the Evaluation Access Terms is free of charge, so no refunds arise from it. Guester is provided to businesses only; this policy does not limit any right that cannot be excluded under applicable law.

Subscription fees are billed in advance for each billing period or Subscription Term. Except as expressly stated in Section 5 or required by applicable law, fees that have been paid or become due are non-refundable and are not credited for partial periods, unused properties, users or modules, or periods in which the Service was not used.

A monthly subscription can be cancelled at any time through the account settings or by writing to info@theartifics.com. Cancellation takes effect at the end of the current monthly billing period, and the Service remains available until then. No refund or credit is given for the remainder of the month in which the subscription is cancelled. No further charges are made after cancellation takes effect.

Annual and other multi-month subscriptions run for the full Subscription Term stated in the Order. If the Customer cancels or stops using the Service before the end of the term, the Service remains available until the end of the term and no refund is given for the remaining period, unless Section 5 applies. Where the Order provides for automatic renewal, the Customer can prevent renewal by giving notice at least thirty (30) days before the end of the current term.

We refund the prepaid fees attributable to the unused portion of the affected Subscription Term, calculated pro rata by day, if:

  • the Customer terminates the Agreement or an affected Order because of our material breach that we have not cured within the cure period stated in the Agreement;
  • we discontinue the Service or a paid module, or terminate an Order for reasons other than the Customer’s breach;
  • a change required by law or by a third-party platform materially reduces the paid Service, or a change to the Agreement takes effect on notice under Section 24 of the Agreement, and in either case the Customer terminates the affected module or Order as permitted by the Agreement;
  • the Customer terminates the affected Service following an unresolved material objection to a new subprocessor under the Data Processing Agreement;
  • the Customer terminates the Agreement or an affected Order because we become insolvent or subject to insolvency proceedings, as permitted by the Agreement;
  • a force majeure event prevents performance for more than thirty (30) consecutive days and either party terminates the affected Order; or
  • we terminate the affected module after failing to correct a non-conformity under the warranty in the Agreement, or after an intellectual property claim.

No refund is due if we suspend or terminate the Service because of the Customer’s breach, non-payment, unlawful use or breach of sanctions or export control laws.

If we charge an amount in error, including a duplicate charge or a charge that does not match the accepted Order, we correct it by refund or credit once the error is confirmed. Invoice disputes must be raised in writing within thirty (30) days of the invoice date, with a description of the disputed amount. The undisputed portion must be paid on time. Please contact us before initiating a chargeback or payment reversal so that we can resolve the issue; an unjustified chargeback may lead to suspension under the Agreement.

Upgrades, such as adding properties, users or modules, take effect when accepted and are charged pro rata for the rest of the current billing period or term. Downgrades and reductions take effect at the start of the next billing period or renewal term and do not create a refund or credit for the current period.

Approved refunds are paid within thirty (30) days to the original payment method or, if that is not possible, by bank transfer to an account held by the Customer, in the currency of the original payment. Taxes are refunded or adjusted only to the extent permitted by law. Bank, currency conversion and payment provider charges that we cannot recover are not refunded, except for refunds due under Section 5 and corrections of our billing errors under Section 6, which are paid in full without deduction. Fees paid to third parties, such as PMS, OTA, channel manager or email providers, are not covered by this policy.

Requests regarding cancellation, refunds or billing can be sent to info@theartifics.com from the account administrator’s email address. Version 4.1. The document date shown at the top of this page is the date this version was published. Changes to this policy do not reduce refund rights for a Subscription Term already paid.
